These Terms of Service ("Terms") apply to your use of brainmaxe.com and its games (the "Service"), operated by Dynavor International, [Country — to be confirmed] ("Brainmaxe", "we", "us"). By using the Service you agree to these Terms.
1. Your account
- You sign in with a Google account. One Brainmaxe account per person.
- You must be at least 13 years old, and have a parent's permission if you are under the age of majority where you live.
- You are responsible for activity on your account. Tell us straight away if you think it has been misused.
2. Weekly pass
- Games on Brainmaxe are unlocked with a weekly pass. A pass costs $0.25 (USD) and gives your account unlimited play on all games for 7 days from the moment the payment is confirmed.
- The pass is a one-time purchase, not a subscription. It does not renew automatically and we never charge you again without you buying again.
- To keep playing after your pass ends, buy a new pass. If you buy while a pass is still active, the new 7 days are added to the end of your current pass.
- A pass is personal to your account. It has no cash value and cannot be transferred, resold or shared.
- There is no free trial. The price is shown before you pay.
3. Payments
Payments are processed by PayPal under PayPal's own terms. Your pass activates once PayPal confirms the payment. If a payment is reversed, charged back or refunded, the related pass time is removed from your account.
4. Refunds
Refunds are handled under our Refund & Cancellation Policy, linked at the bottom of every page.
5. Acceptable use
You agree not to:
- share your account or pass with other people;
- cheat, tamper with the Service, or exploit bugs;
- use bots, scripts or automated tools to play or to create accounts;
- copy, modify or redistribute our games or website content;
- interfere with the security or operation of the Service;
- use the Service for anything illegal.
6. Games and content
Games on Brainmaxe may be created by third-party developers and licensed to us. We add a new game each week and may change or remove games at any time. All content on the Service is owned by us or our licensors.
7. Suspension and termination
We may suspend or close accounts that break these Terms, for example for account sharing, cheating, fraud or payment abuse. You can stop using the Service and ask us to delete your account at any time. Remaining pass time on an account closed for a breach of these Terms is not refunded.
8. Disclaimers
The Service is provided "as is" and "as available". We work to keep it running smoothly but do not promise it will always be available or error-free. If an outage on our side stops you playing for a significant part of your pass, contact us and we will extend your pass to make up for it.
9. Limitation of liability
To the extent allowed by law, our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses. Nothing in these Terms limits rights you have under consumer law that cannot be excluded.
10. Changes to these Terms and prices
We may update these Terms or the pass price. We will post changes here and update the "Last updated" date. A price change never affects a pass you have already bought.
